On 3-8-2005 the Board met in Regular Session and voted to issue a non-disciplinary letter of concern. A letter of concern is an advisory letter to notify the physician that, while there is insufficient evidence to support disciplinary action, the board believes the physician should modify or eliminate certain practices.
Dr Radoff filed a 2005 renewal form on January 11, 2005 and noted in the form that he had received a traffic citation for DUI on 2-8-2004, a class 1 misdemeanor.
The Board voted to issue a letter of concern noting that Dr. Radoff did not report the misdemeanor charge within 10 days of receiving the charge as required by ARS 32-3208. While there was insufficient evidence to conclude an intentional violation of ARS 32-3208, the Board expressed concern regarding the lack of timely reporting.
