This matter was consolidated on September 13, 2011 with Complaint Case Nos. 11-07 and 11-08
In the course of treating patients A.B., E.D., and J.F., Respondent failed to obtain written informed consent advising them that he was providing homeopathic medical treatment. Respondent failed to obtain from patients A.B., E.D., and J.F., informed consent for IV colchicine. Respondent filed to document patients' vital signs, physical examination, medical plan, treatment, and patient response in the medical record for A.B., E.D., and J.F., during the month of March, 2011. Respondent failed to register his nurse as a homeopathic medical assistant.
Respondent is placed on probation for one year, but no earlier than 6 months from the effective date of the order may apply for early termination of probation upon showing successful completion of the terms of the Order. Within 30 days of the effective date of the Order, Respondent shall submit a written homeopathic informed consent to the Board for approval. A Nondisciplinary Order for Practice Limitation dated 9-13-2011 shall remain in effect indefinitely and Respondent shall not provide IV Colchicine therapy. Respondent shall take 12 hours of continuing education in patient record keeping and management. Following completion of continuing education requirements Respondent shall submit to a random audit of 5 medical records created after the effective date of the Order. Respondent shall cease and desist from employing nonregistered homeopathic medical assistants.
On March 12, 2013 the Board met in regular session and voted to return the physician's license to an active status. They noted Dr. Olsztyn had met all of the terms of the Consent Agreement and Order. The Board also confirmed that the Non-Disciplinary Order for Practice Limitation relating to the provision of IV Colchicine therapy is still in effect and that Dr. Olsztyn is not to provide IV Colchicine therapy.
